What is a Business Will?
We all know what a Will is - a document that we prepare to manage your financial affairs after you pass away - who gets the home, who gets the chattels and so on.

In some cases, the assets, which may include your business, will pass under the terms of your Will.

Often, it is better if the management of the business is left to your co-directors not your next of kin, as they will know more intimately what to do to keep your business trading.

In that way, it is helpful and in some cases crucial to prepare a Will for your business (and a distinct part of that Will for your personal affairs, such as your home and family assets).

What is a business LPA?
A lasting power of attorney or LPA is a document that gives the power to a special nominated person known as your "attorney" (but that does not need to be a lawyer) to manage your financial affairs in the event that you lose mental capacity.

In most cases you may wish for your spouse say to be your attorney to look after your financial affairs if you were to lose capacity. However, in some cases, it may be far more beneficial to appoint a business attorney to specifically only manage your business affairs, for example, your business partner, or co-director etc, rather than it being say, your spouse.
